Terms of Service

Welcome to PhoneSnaps. These Terms of Service ("Terms") govern your use of phonesnaps.com and the PhoneSnaps photo-enhancement service (the "Service"), operated by Mimi John LLC ("PhoneSnaps," "we," or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Plain-English summary: PhoneSnaps enhances your photos using technology. You are responsible for verifying every enhanced photo accurately represents the property before publishing it anywhere. Use the watermark tool when required. Don't sue us if your PhoneSnaps Enhanced photo causes a problem on your listing.

1. Who Can Use PhoneSnaps

You must be at least 18 years old and legally able to enter into binding contracts to use the Service. If you are using PhoneSnaps on behalf of a business, brokerage, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@phonesnaps.com if you suspect unauthorized access to your account. We may suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraudulent or abusive activity.

3. Photo Ownership and Rights

You retain full ownership of all photos you upload to PhoneSnaps. We claim no ownership rights to your original or enhanced images.
You represent and warrant that you have all necessary rights, licenses, and permissions to upload each photo, including (where applicable) the property owner's permission, the photographer's permission, and any required disclosures or consents from people depicted in the photos.
You grant PhoneSnaps a limited license to process, store, and modify your uploaded photos solely for the purpose of providing the Service to you. We may retain technical copies of uploaded and enhanced images on our servers for as long as your account is active and for a reasonable period afterward for service-improvement and dispute-resolution purposes.
We will not sell your photos, distribute them publicly, or use them for marketing without your explicit written permission.

4. Nature of the Enhancement Service

PhoneSnaps uses automated technology to enhance lighting, color, contrast, atmospheric conditions, and other visual qualities of submitted photos. The Service may also, when requested via user instructions, perform virtual staging, sky replacement, twilight conversion, or other transformations.

Important — limitations of the Service: Automated photo enhancement is not perfect. The Service may occasionally produce results that differ from your expectations, including but not limited to: alterations to architectural elements, structural details, exterior views through windows, color shifts, or visual artifacts. You are solely responsible for reviewing every enhanced image and verifying its accuracy before using or publishing it.

5. Your Responsibilities — MLS, Disclosure, and Listing Compliance

If you are a real estate professional or property lister, you understand and agree:

Verification before use: You will personally review each enhanced photo and confirm it accurately represents the actual property before publishing to MLS, websites, social media, advertising, or any public-facing platform.
Disclosure of material alterations: Many MLSes, real estate boards, and consumer-protection laws require disclosure when listing photos have been materially altered (e.g., virtual staging, sky replacement, removal/addition of features). You are responsible for knowing and complying with the disclosure rules of every jurisdiction and MLS in which you operate.
Watermark tool: PhoneSnaps provides an optional "Virtually Enhanced" watermark feature in the gallery. You are responsible for applying watermarks where appropriate. PhoneSnaps does not automatically determine which photos require disclosure.
NAR, state, and brokerage rules: You agree to comply with all applicable rules from the National Association of REALTORS®, your state real estate licensing board, your local MLS, and your brokerage when using PhoneSnaps-enhanced photos.

6. Credits, Payments, and Refunds

The Service operates on a credit system. Each photo enhancement consumes one credit. Credits are purchased in packs through Stripe.
Credits are non-transferable and have no cash value outside the Service.
Used credits are non-refundable except via the in-app rejection process described below.
Rejection process: If an enhanced image has a material problem, you may submit it for review using the 🚩 button in your gallery. PhoneSnaps will review and either (a) refund the credit and remove the image, or (b) provide a complimentary re-enhancement of that image at our discretion. The decision of PhoneSnaps in such reviews is final.
Pricing changes: We may modify pricing for credit packs at any time. Existing credits in your account at the time of any price change retain their original purchased value.

7. Acceptable Use

You agree not to use PhoneSnaps to:

Upload or process photos of property you do not own, list, or have written permission to photograph
Upload images depicting illegal content, minors in inappropriate contexts, or content that violates third-party rights
Misrepresent property to potential buyers, tenants, or guests in a way that constitutes fraud or false advertising
Reverse engineer, scrape, or attempt to extract our enhancement technology
Resell or sublicense access to the Service without our written permission
Use the Service in any way that violates applicable law

8. Service Availability and Modifications

We aim to provide reliable Service but make no guarantees of uptime, availability, processing speed, or specific result quality. We may modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes affecting paid features.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that enhanced images will be free from artifacts, errors, or material alterations, nor that the Service will meet specific quality, MLS, or jurisdictional standards.

10. Limitation of Liability

To the maximum extent permitted by law, Mimi John LLC, its members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to lost commissions, lost listings, damaged reputation, MLS violations, regulatory fines, lawsuits, or claims by third parties (including buyers, sellers, tenants, guests, or other agents).

Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of: (a) the amount you paid PhoneSnaps in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Mimi John LLC and its members, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any MLS rule, real estate licensing requirement, or consumer-protection law; (d) any photo you upload or publish; or (e) any misrepresentation of property arising from your use of enhanced images.

12. Termination

You may terminate your account at any time by contacting support@phonesnaps.com. We may suspend or terminate your account at our discretion if we believe you have violated these Terms, used the Service fraudulently or abusively, or otherwise endangered other users or the integrity of the Service. Upon termination, unused credits may be forfeited.

13. Privacy

We collect and store the minimum information needed to provide the Service: your name, email address, encrypted password, payment processor token (we do not store full credit card numbers), and your uploaded and enhanced photos. We do not sell user data. We use third-party services (Stripe for payments, possibly other sites for image processing) and your data may be transmitted to these services as part of providing the Service. By using PhoneSnaps you consent to this processing.

14. Changes to These Terms

We may update these Terms from time to time. The current version and effective date are shown at the top of this page. Material changes will be communicated to active users via email and/or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Santa Barbara County, California, and you consent to personal jurisdiction in those courts.
